Decisions of the U.S. Supreme Court over the last half century have wrongfully interpreted the First Amendment to the U.S. Constitution and have in effect inferred if not declared that God does not exist.

Other decisions of the U.S. Supreme Court have usurped the function of the legislative and executive branches of the Congress and State legislatures with the result that Congress should now take action authorized by Article III, 2.2 of the U.S. Constitution to except these subject matter areas from the jurisdiction of the federal court system:

(1) Acknowledgement of God
Senators Allard and Shelby and Congressmen Aderholt, Akin, Emerson, Istook, Paul and Pickering have introduced bills in the 108th Congress on this subject.

(2) American women are on a pedestal – not in a cage – the claimed right to an abortion is removed from the jurisdiction of the U.S. Supreme Court.

(3) Defining Marriage as one man and one woman.
Senator Allard and Congressman Hostettler and Congresswoman Musgrave have introduced legislation in the 108th Congress on this subject.

(4) Foreign court decisions are not to be used in interpreting the U.S. Constitution.

(5) Pornography – written, in movies or TV is not protected by the First Amendment.

(6) Decisions hampering law enforcement are rejected.

(7) Remove ability to interfere in elections.

(8) To prohibit federal judges from imposing taxes.

On August 18, 1821, Thomas Jefferson, author of the Declaration of Independence wrote to Charles Hammond and expressed his fear that, of the three branches of government which were created, the one he feared the most was the federal judiciary in these words:

“The federal judiciary is …working like gravity by night and by day, gaining a little tomorrow, and advancing its noiseless step like a thief over the field of jurisdiction until all shall be usurped from the States, and the government of all be consolidated into one (i.e., federalization).”

Beginning in 1799 in the case of Turner v. Bank of North America, the U.S. Supreme Court has recognized and affirmed the authority of Congress in limiting the jurisdiction of the U.S. Supreme Court. In at least five other cases the U.S. Supreme Court has recognized this Congressional authority.

Congress used the authority in Article III, 2.2 twelve times in the 107th Congress to except certain areas from the jurisdiction of the U.S. Supreme Court.

The individuals and the organizations they represent have signed this letter with the request that Congress exercise the authority in Article III, 2.2 of the U.S. Constitution to except the subject matter contained in this letter from the jurisdiction of the U.S. Supreme Court.
